Terms & Conditions

These Terms & Conditions ("terms") are an agreement between you and the independent developer of Galactic Rock ("we", "us", "our") about the Galactic Rock: Space Swing apps for Android, iPhone and iPad ("the game") and this website. By downloading, installing or playing the game, or using the website, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the game.

1. Who can play

The game is for a general audience. If you are under the age of majority where you live, you may use the game only with the involvement of a parent or guardian, who accepts these terms for you. Your use of Google Play and Google Play Games must also follow Google's age requirements, and your use of the App Store and Game Center Apple's.

2. Your licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download, install and play the game on Android, iPhone and iPad devices that you own or control, for your own non-commercial entertainment, in line with these terms and the terms of the store you got it from (Google Play or the App Store).

3. What you may not do

You agree not to:

• copy, sell, rent, lease, sublicense, distribute or publish the game, or any of its code, graphics, sounds or text;
• modify, adapt or translate the game, or decompile, disassemble or reverse engineer it, except where the law allows this despite this restriction;
• cheat: use bots, scripts, modified versions of the game, emulators set up to manipulate play, or bugs to gain scores, leaderboard positions or achievements;
• use the game or the website in any unlawful way, or in a way that could harm us, other players or the services we use;
• remove or change any copyright, trademark or licence notices;
• present the game, or any part of it, as your own work, or use our name or icon in a way that suggests we endorse you.

4. Ownership

The game and the website, including their code, gameplay design, graphics, artwork, sound effects, text, the name Galactic Rock and its icon, belong to us or our licensors and are protected by copyright, trademark and other laws. These terms do not give you any ownership of the game or the right to use its name, icon or artwork, except to share links to the game and screenshots or videos of your own gameplay for non-commercial purposes.

The Android game includes open-source software (such as Android Jetpack libraries and Kotlin) and Google Play services, and the iPhone and iPad game uses Apple's system frameworks (such as Game Center), each used under its own licence or terms. Those licences, not these terms, govern those components. The game's icon and some promotional artwork for the game and this website were created with the help of AI image tools and then edited by us.

5. Originality

Galactic Rock is an original game. Swinging, orbiting and slingshot mechanics are a long-standing idea shared by many games; Galactic Rock is our own take on it and does not use the names, artwork, sounds, music or code of any other game. It is not affiliated with or endorsed by any other game or company. If you believe anything in the game or on this website infringes your rights, please email us with the details, and we will review it promptly and change or remove it if needed.

6. Supported devices

The game requires an Android phone or tablet running Android 8.0 or later, or an iPhone or iPad runningiOS 17 or later, and plays in portrait. We can't guarantee that it works on every device or system version.

7. Price, ads and purchases

The current version of the game contains no advertising and no in-app purchases. Any price for the game is shown on its Google Play or App Store listing, and purchases are governed by that store's terms and refund policy. If we ever add ads or purchases, the details will be shown clearly in the game and on its store listing before you pay for anything.

8. Leaderboard and achievements

The High Score leaderboard and achievements are provided through Google Play Games on Android, operated by Google, and through Game Center on iPhone and iPad, operated by Apple, each under its own terms and privacy policy. Using them is optional. Your name and score may be visible to other players according to your Play Games or Game Center settings. We may remove scores or achievements that appear to come from cheating, a modified game or a bug, and we may reset the leaderboard if needed to keep it fair. Scores and achievements have no monetary value.

9. Health and safety

• Photosensitivity warning: the game contains bright colours, flashing light effects, fast motion and screen shake. A very small number of people may have seizures when exposed to certain lights or patterns, even with no history of epilepsy. If you or anyone in your family has had seizures or epilepsy, talk to a doctor before playing. Stop playing immediately and seek medical advice if you feel dizzy, have altered vision, eye or muscle twitches, disorientation or any involuntary movement.
• Take regular breaks, play in a well-lit room, and stop if your eyes, hands or wrists feel tired or sore.
• You can turn off vibration and sound in the game's Settings.
• Never play while driving, cycling or walking in traffic, or in any situation that needs your full attention.

10. Updates and availability

We may update, change, suspend or stop offering the game, or any of its features, at any time, for example to fix bugs, improve it, keep it secure or follow store rules. Some updates may be needed to keep playing. We can't promise that the game or the website will always be available or free of errors.

11. Feedback

If you send us ideas, suggestions or bug reports, we may use them to improve the game without any obligation or payment to you. You don't have to send us anything.

12. Disclaimer

To the fullest extent permitted by law, the game and the website are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the game will be uninterrupted, error-free, or that your scores or saved data will never be lost.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, scores, profits or goodwill, arising from your use of, or inability to use, the game or the website. Where our liability cannot be excluded, it is limited to the amount you paid for the game, if anything.

Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law, such as for death or personal injury caused by negligence or for fraud, or affects your statutory rights as a consumer under the laws of the country where you live.

14. Google Play and the App Store

If you get the game through Google Play, Google Play's Terms of Service also apply to your download and to any purchase.

If you get the game from the App Store, Apple's Media Services Terms and Conditions, including its standard Licensed Application End User License Agreement, also apply to the download and use of the game.

These terms are between you and us, not Google or Apple. We, not Google or Apple, are responsible for the game and for any support, maintenance and claims relating to it.

15. Ending this agreement

You can stop using the game at any time by uninstalling it. Your licence ends automatically if you break these terms; you must then stop using and uninstall the game. Sections 4, 12, 13, 16 and 17 continue to apply after the licence ends.

16. Governing law and disputes

These terms are governed by the laws of India. If a dispute arises, please contact us first so we can try to resolve it informally. Otherwise, the courts of India have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in its courts.

17. General

If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a part of these terms straight away, we can still enforce it later. We may transfer our rights and obligations under these terms to someone who takes over the game; your rights under these terms will not be reduced. These terms, together with the Privacy Policy, are the whole agreement between you and us about the game and the website.

18. Changes to these terms

We may update these terms from time to time, for example when we add features or when the law changes. We will change the date at the top, and for significant changes we will also mention it in the app's release notes. If you keep using the game after a change takes effect, the updated terms apply.
